Terms and Conditions

The following terms and conditions govern the services provided by The Organized Move. By engaging our services, you agree to these terms.
 

Services Included:

The Organized Move offers a comprehensive range of services tailored to meet your needs, including:

  • Packing and/or Unpacking Services

  • Move Day Management

  • Collectibles Advisory / Selling

  • Decluttering & Organizing Services

  • Clean-up & Haul Away

  • New Home Setup

  • Downsizing & Rightsizing

  • Senior Move Management

  • Estate Clearing

  • Storage Solutions
     

The Organized Move agrees to provide the services indicated above in accordance with the policies outlined below.
 

Payment Policy:

All services are billed at an hourly rate, including consultation, decluttering, pre-listing consultation, staging, hands-on organizing, packing, unpacking, clean-up, haul away, collectibles advisory, selling, and other services listed above. The number of workers required will be determined during the initial consultation and will depend on the scope of work. Consumables such as boxes, packing supplies, and other materials are additional expenses and will be outlined in the initial estimate. Any changes in the quantity of these materials during the job will be invoiced accordingly.

Payment is due upon receipt. If payment is not received within 7 days of the due date, a one-time 5% late fee will be added to the outstanding balance. Additionally, a 5% interest charge will be applied to the total outstanding balance at the end of each 30-day period until full payment is received.
 

Liability Release:

By engaging The Organized Move, you release, waive, and discharge any claims against The Organized Move for any loss, liability, damage, or costs, including bodily injury or property damage, arising from your actions or omissions, to the fullest extent permitted by law. This includes items removed for donation or trash, and papers shredded (whether onsite or offsite). The Organized Move is fully insured to protect both your property and our team members. Our liability for loss or damage to your belongings is limited to the coverage provided by our insurance, unless additional coverage is purchased by you.

Additional Insured: Upon request, The Organized Move may list your business as an additional insured under our policy, subject to approval and any additional costs. Please notify us in advance if this is required.
 

Rodent Infestation Policy:

In the event that rodent activity or infestation is detected during the course of our work, The Organized Move reserves the right to immediately cease operations to allow for proper assessment and remediation by a qualified third party.

  • Payment for Work Performed: If work is halted due to rodent detection, you agree to pay for all services rendered up to the point of detection, including the full day on which work was interrupted. Additionally, you will be responsible for payment for the scheduled time originally allotted for the project (up to the full duration of the booked days) unless alternative work arrangements can be made.

  • Rescheduling and Standby Charges: If remediation requires more than one business day, The Organized Move will work with you to reschedule the remaining work. However, if our team is unable to be reassigned to other projects during the originally scheduled time, a standby fee equivalent to 50% of the daily rate will be charged for each day our team is on hold due to the infestation. This standby fee will be waived if we can resume work the same day as remediation.

  • Resumption of Work: Once the infestation has been addressed and it is safe to resume work, The Organized Move will continue with the project as scheduled or on the next available date. Any additional costs incurred due to delays beyond our control will be the responsibility of the client.
     

California Residents: In accordance with California law, this Liability Release is not intended to release liability for gross negligence, willful misconduct, or any other conduct that cannot legally be waived.
 

Third-Party Vendor Policy:

The Organized Move may recommend or engage third-party service providers to meet specific client needs. These providers operate as independent contractors, and their services may be paid for either by The Organized Move or directly by the client.

  • Insurance and Liability: If The Organized Move hires and pays the third-party vendor, the vendor must carry comprehensive general liability insurance and name both The Organized Move and the client as additional insureds. If the client pays the vendor directly, it is the client’s responsibility to verify the vendor's insurance and handle any claims directly with the vendor.

  • Indemnification: When The Organized Move hires a vendor, the vendor agrees to indemnify and hold harmless The Organized Move from any claims, damages, or liabilities arising from their work.

  • Responsibility for Third-Party Services: Whether paid by The Organized Move or the client, the vendor is responsible for any damages or issues that arise from their services. Any claims should be directed to the vendor’s insurance provider.
     

Dangerous Goods:

You warrant that your goods do not include any dangerous, hazardous, or illegal items. If such items are found during the course of our work, The Organized Move will notify you immediately and request that you arrange for their removal or proper handling. We reserve the right to pause our services until the situation is resolved, if required. The Organized Move will not incur any additional costs or liability related to the discovery, handling, or disposal of such items. Failure to address the issue promptly may result in delays or additional charges.
 

Customer Obligations and Warranties:

  • Accuracy of Information: You warrant that all information provided to The Organized Move is accurate and complete. This information is critical for assessing the scope of work and ensuring that resources are appropriately allocated.

  • Fragile and Valuable Items: You are responsible for informing The Organized Move in writing of any fragile or valuable items (such as artwork, jewelry, or antiques) before the commencement of services. The Organized Move may refuse to transport such items if deemed necessary or require additional handling at your cost.

  • Presence During Loading/Unloading: As part of our concierge white-glove service, The Organized Move does not require you to be present during loading or unloading. We manage the entire process with the utmost care and professionalism, ensuring that all your belongings are handled safely and securely. However, we will communicate with you as necessary to confirm key decisions or address any concerns that may arise.
     

Scope of Services:

The services provided by The Organized Move include a comprehensive range of Move Management services tailored to your specific needs as outlined in the estimate provided. This includes, but is not limited to, hands-on decluttering & organizing, packing, unpacking, move day management, clean-up & haul away, collectibles advisory/selling, removal of trash and/or packing materials, donation drop-offs, and more.

The scope of services is based on the description of work outlined in the estimate you received. Any changes or modifications to the agreed-upon services must be made in writing and may result in additional fees. The Organized Move reserves the right to adjust the scope of services as necessary to address unforeseen circumstances or challenges, with your approval.
 

Additional Work and Verbal Agreements:

During the course of our work, you may request additional services or modifications to the originally agreed-upon scope. While we strive to provide written estimates for all additional work, we understand that in certain circumstances, immediate verbal agreements may be necessary to avoid delays.

  • Verbal Agreement Authorization: The Organized Move may accept verbal authorization for additional work or changes to the scope of services up to a maximum of $2,000 without requiring an immediate written estimate. This amount will be added to the final invoice, and by providing verbal authorization, you agree to pay for these additional services.

  • Documentation: For clarity and record-keeping purposes, The Organized Move will document the verbal agreement, including the scope of the additional work and the agreed-upon cost. This documentation will be included in the final invoice.

  • Confirmation: We will follow up with a written summary of the additional work and costs as soon as possible, typically by the end of the business day or within 24 hours. You will have the opportunity to review this summary, but your verbal agreement will be considered binding.

  • Dispute Resolution: In the event of any disagreement regarding additional work verbally authorized, The Organized Move will rely on the documented agreement and any related communications (such as text messages or emails). By engaging our services, you agree that verbal authorizations up to the set amount are binding and will be honored in the final billing.
     

Dispute Resolution and Governing Law:

In the event of a dispute, The Organized Move requires that mediation or arbitration be pursued before any legal action. This agreement is governed by the laws of the state in which the service is provided.
